Application Terms and Conditions

We at Workbase Platforms Sp. z o.o. (doing business as “Workbase”) ("we," "us," or "our") value the trust you place in us by applying for a position within our company. This "Application Terms and Conditions" document (hereinafter referred to as "Agreement") is designed to protect both parties involved in the recruitment process. Our goal is to create a transparent, fair, and respectful environment where your privacy and the integrity of our recruitment process are both safeguarded. This Agreement is governed by the laws of Poland.

Mutual Confidentiality and Respect

  1. Confidential Handling of Information:

    • Our Commitment: We are dedicated to safeguarding the personal data you provide during the application process. Your personal information, including your name, contact details, resume, and any other data you share with us, will be treated with the highest level of confidentiality. This information will be used strictly for evaluating your suitability for the position you applied for or other roles within our company that may match your profile, provided you consent to this.

    • Data Processing: All personal data will be processed in accordance with the General Data Protection Regulation (GDPR) and the Polish Act on the Protection of Personal Data. You have the right to access, correct, or request the deletion of your data at any time. If you wish to exercise these rights, please contact legal@workbase.com. We ensure that your data will be stored securely and will not be shared with third parties without your explicit consent, unless required by law.

  2. Data Security and Usage:

    • Our Responsibility: We are committed to safeguarding your data by implementing advanced security measures, including encryption, regular security audits, and secure storage solutions. Only authorized personnel involved in the recruitment process will have access to your data. We guarantee that your data will be used exclusively for assessing your suitability for the position you applied for or other opportunities within our company, should you express interest.

    • Retention of Data: Your data will be retained for a period of 6 months after the completion of the recruitment process, unless you consent to a longer retention period. After this period, your data will be securely deleted or anonymized, unless otherwise required by Polish law.

    • Third-Party Sharing: We will not share your data with third parties unless necessary for the recruitment process (e.g., background checks) and with your explicit consent. Any third parties involved will be required to adhere to confidentiality agreements and data protection standards equivalent to those outlined in this Agreement.

  3. Professional Conduct and Integrity:

    • Our Approach: We aim to conduct the recruitment process in a professional and respectful manner, providing clear and timely communication at each stage. We value transparency and will keep you informed about the status of your application. Any information we share with you is intended to help you succeed in our recruitment process.

    • Your Responsibility: We expect that you will approach the recruitment process with honesty and integrity. This includes providing accurate information about your qualifications and experience. We also ask that you refrain from recording or distributing any part of the interview or assessment process, as this helps us maintain a fair and respectful environment for all applicants.

  4. Confidentiality of the Recruitment Process:

    • Our Commitment: We treat all information related to your application and our recruitment process with the utmost confidentiality. This includes, but is not limited to, interview content, assessment results, communication details, and any personal insights shared during the process. We assure you that this information will only be accessible to those directly involved in your recruitment and will not be disclosed to unauthorized third parties under any circumstances.

    • Your Commitment: You agree not to disclose any details related to our recruitment process, including interview questions, assessment tasks, or any feedback received. This obligation is essential to ensure a fair and equitable process for all candidates.

  5. Enhanced Candidate Support:

    • Our Promise: We recognize that the application process can be challenging, and we are dedicated to supporting you every step of the way. Should you need any special accommodations during your interview or assessment, we are here to ensure your experience is as comfortable and accessible as possible.

Governing Law and Dispute Resolution

  1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Poland. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Poland.

  2. Breach of Agreement: In the event that either party breaches any of the terms outlined in this Agreement, the non-breaching party is entitled to compensation in the amount of 20,000 PLN (Polish Zloty) as liquidated damages. This amount has been determined as a reasonable estimate of the potential harm caused by a breach and is intended to cover costs such as reputational damage, loss of business opportunities, and administrative expenses. If the actual damages exceed the liquidated damages amount, the non-breaching party may seek additional compensation to cover the full extent of the damages incurred, including claims for financial losses, legal costs, and any other expenses directly related to the breach. The breaching party also agrees to bear all reasonable legal costs incurred by the non-breaching party in enforcing this Agreement, including attorney fees and court costs. For example, if the Company were to improperly share any confidential information from the Applicant’s application with an unauthorized third party, the Company would be liable to pay the Applicant the liquidated damages amount of 20,000 PLN, or more if the actual damages are higher.

  3. Dispute Resolution: Should a dispute arise, we are committed to resolving it amicably through good-faith discussions. If a mutual resolution cannot be achieved, we encourage the use of mediation or arbitration, as these methods are designed to offer a fair and efficient resolution in accordance with Polish law. We believe in minimizing disruption and maintaining a positive relationship throughout the process.

Effective Date

This Agreement becomes effective on the date you submit your application to us and remains in effect indefinitely to protect the confidentiality and integrity of the process.

By engaging in our recruitment process, you acknowledge that you have read, understood, and agree to these terms. We are committed to handling your application with the utmost care and respect, and appreciate your cooperation in maintaining the confidentiality and professionalism of our recruitment process.
